[10]When thou goest forth to war against thine enemies, and the LORD thy God hath delivered them into thine hands, and thou hast taken them captive,
[11]And seest among the captives a beautiful woman, and hast a desire unto her, that thou wouldest have her to thy wife; - Bible:OT:Deuteronomy 21:10:11 (bible torah)

[10]And they burnt all their cities wherein they dwelt, and all their goodly castles, with fire.
[11]And they took all the spoil, and all the prey, both of men and of beasts.
[12]And they brought the captives, and the prey, and the spoil, unto Moses, and Eleazar the priest, and unto the congregation of the children of Israel, unto the camp at the plains of Moab, which are by Jordan near Jericho.
[13]And Moses, and Eleazar the priest, and all the princes of the congregation, went forth to meet them without the camp.
[14]And Moses was wroth with the officers of the host, with the captains over thousands, and captains over hundreds, which came from the battle.
[15]And Moses said unto them, Have ye saved all the women alive?
[16]Behold, these caused the children of Israel, through the counsel of Balaam, to commit trespass against the LORD in the matter of Peor, and there was a plague among the congregation of the LORD.
[17]Now therefore kill every male among the little ones, and kill every woman that hath known man by lying with him.

Chapter: Meaning Of The Saying Of Allah, The Mighty And Sublime: "Also (Forbidden Are) Women Already Married. Except Those (Slaves) Whom Your Right Hands Possess."
It was narrated from Abu Sa'eed Al-Khudri that the Prophet of Allah sent an army to Awtas. They met the enemy, fought them, and prevailed over them. They acquired female prisoners who had husbands among the idolaters. The Muslims felt reluctant to be intimate with them. Then Allah, the Mighty and Sublime revealed:
"Also (forbidden are) women already married, except those (slaves) whom your right hands possess," meaning, this is permissible for you once they have completed their 'Iddah. - Sahih:An Nasai:3333 (islam)
-At the battle of Awtas, the enemy was a coalition of Thaqifs, Hawazins, Joshimites, Saadites, they were polytheist, but does 4:24 is valid for Muslim husband?
- Why is Allah not clear about that?
Chapter: Regarding Intercourse With Captives
Abu Sa’id Al Khudri said “The Apostle of Allaah(ﷺ) sent a military expedition to Awtas on the occasion of the battle of Hunain. They met their enemy and fought with them. They defeated them and took them captives. Some of the Companions of Apostle of Allaah (ﷺ) were reluctant to have relations with the female captives because of their pagan husbands. So, Allaah the exalted sent down the Qur’anic verse “And all married women (are forbidden) unto you save those (captives) whom your right hand posses.” This is to say that they are lawful for them when they complete their waiting period. - Sahih:Abu Dawud:2155 (islam)
-If his companions were reluctant, why Mohamed and Allah gave the authorization anyway to do such horrible thing?
- Is it rape?
- What is a Sabaya?
Chapter: It is permissible to have intercourse with a female captive after it is established that she is not pregnant, and if she has a husband, then her marriage is annulled when she is captured
Abu Sa'id al-Khudri (Allah her pleased with him) reported that at the Battle of Hanain Allah's Messenger (ﷺ) sent an army to Autas and encountered the enemy and fought with them. Having overcome them and taken them captives, the Companions of Allah's Messenger (may peace te upon him) seemed to refrain from having intercourse with captive women because of their husbands being polytheists. Then Allah, Most High, sent down regarding that:
" And women already married, except those whom your right hands possess (iv. 24)" (i. e. they were lawful for them when their 'Idda period came to an end). - Sahih:Muslim:1456a (islam)
-Does the companion were more moral than Mohamed and Allah?
- Is it only for Polytheist or is it valid for people of the book?
- The Quran is not clear, could it be valid for Muslim Captives?
Chapter: It is permissible to have intercourse with a female captive after it is established that she is not pregnant, and if she has a husband, then her marriage is annulled when she is captured
Abu Sa'id al-Khudri (Allah be pleased with him) reported that Allah's Apostle (ﷺ) sent a small army. The rest of the hadith is the same except this that he said:
Except what your right hands possess out of them are lawful for you; and he did not mention" when their 'idda period comes to an end". - Sahih:Muslim:1456b (islam)
-Can you have sex with you're female captive?
- Can she refuses to have sex without rejecting the quran (23:5-6 and 70:30)?
Chapter: It is permissible to have intercourse with a female captive after it is established that she is not pregnant, and if she has a husband, then her marriage is annulled when she is captured
This hadith has been reported on the authority of AbuSa'id (al-Khudri) (Allah be pleased with him) through another chain of transmitters and the words are:
They took captives (women) on the day of Autas who had their husbands. They were afraid (to have sexual intercourse with them) when this verse was revealed:" And women already married except those whom you right hands posses" (iv. 24) - Sahih:Muslim:1456d (islam)
-Since at autas it was polytheist slaves, is it ok to have sex if you have Muslim slaves?
Chapter: The ruling on coitus interrupts ('Azl)
Abu Sirma said to Abu Sa'id al Khadri (Allah he pleased with him):
0 Abu Sa'id, did you hear Allah's Messenger (ﷺ) mentioning al-'azl? He said: Yes, and added: We went out with Allah's Messenger (ﷺ) on the expedition to the Bi'l-Mustaliq and took captive some excellent Arab women; and we desired them, for we were suffering from the absence of our wives, (but at the same time) we also desired ransom for them. So we decided to have sexual intercourse with them but by observing 'azl (Withdrawing the male sexual organ before emission of semen to avoid-conception). But we said: We are doing an act whereas Allah's Messenger is amongst us; why not ask him? So we asked Allah's Mes- senger (ﷺ), and he said: It does not matter if you do not do it, for every soul that is to be born up to the Day of Resurrection will be born. - Sahih:Muslim:1438a (islam)
-Is it alright to have a war, to make slaves and have sex with them, even in the 7th century, can you put yourselves in the shoes of the victims?
Chapter: Whoever possessed Arab slaves
Narrated Ibn Muhairiz:
I saw Abu Sa`id and asked him about coitus interruptus. Abu Sa`id said, "We went with Allah's Apostle, in the Ghazwa of Bani Al-Mustaliq and we captured some of the 'Arabs as captives, and the long separation from our wives was pressing us hard and we wanted to practice coitus interruptus. We asked Allah's Messenger (ﷺ) (whether it was permissible). He said, "It is better for you not to do so. No soul, (that which Allah has) destined to exist, up to the Day of Resurrection, but will definitely come, into existence." - Sahih:Al Bukhari:2542 (islam)

Chapter: Ghazwa of Banu Al-Mustaliq or the Ghazwa of Al-Muraisi’
Narrated Ibn Muhairiz:
I entered the Mosque and saw Abu Sa`id Al-Khudri and sat beside him and asked him about Al-Azl (i.e. coitus interruptus). Abu Sa`id said, "We went out with Allah's Messenger (ﷺ) for the Ghazwa of Banu Al-Mustaliq and we received captives from among the Arab captives and we desired women and celibacy became hard on us and we loved to do coitus interruptus. So when we intended to do coitus interrupt us, we said, 'How can we do coitus interruptus before asking Allah's Messenger (ﷺ) who is present among us?" We asked (him) about it and he said, 'It is better for you not to do so, for if any soul (till the Day of Resurrection) is predestined to exist, it will exist." - Sahih:Al Bukhari:4138 (islam)
-Is there any consent for sex to be given by a slave?
Chapter: "And the Command of Allah is a decree determined"
Narrated Abu Sa`id Al-Khudri:
That while he was sitting with the Prophet (ﷺ) a man from the Ansar came and said, "O Allah's Messenger (ﷺ)! We get slave girls from the war captives and we love property; what do you think about coitus interruptus?" Allah's Messenger (ﷺ) said, "Do you do that? It is better for you not to do it, for there is no soul which Allah has ordained to come into existence but will be created." - Sahih:Al Bukhari:6603 (islam)
-Is Mohamed the best model to follow?
Chapter: The ruling on coitus interrupts ('Azl)
Jabir (Allah be pleased with him) reported that a man came to Allah's Messenger (ﷺ) and said:
I have a slave-girl who is our servant and she carries water for us and I have intercourse with her, but I do not want her to conceive. He said: Practise 'azl, if you so like, but what is decreed for her will come to her. The person stayed back (for some time) and then came and said: The girl has become pregnant, whereupon he said: I told you what was decreed for her would come to her. - Sahih:Muslim:1439a (islam)
-Is it ok to pull out to avoid a pregnancy with our slave?
- What if she is not ok since giving birth could manumit her?
And whoever among you cannot [find] the means to marry free, believing women, then [he may marry] from those whom your right hands possess of believing slave girls. And Allah is most knowing about your faith. You [believers] are of one another. So marry them with the permission of their people and give them their due compensation according to what is acceptable. [They should be] chaste, neither [of] those who commit unlawful intercourse randomly nor those who take [secret] lovers. But once they are sheltered in marriage, if they should commit adultery, then for them is half the punishment for free [unmarried] women. This [allowance] is for him among you who fears sin, but to be patient is better for you. And Allah is Forgiving and Merciful. - Quran:An-Nisa 4:25 (islam)

- Do slaves needed to consent for this marriage or just the owner consent is sufficient?
- What is indecency after marriage, what is the punishment?
- If a slave become a slave wife, why is the punishment for indecency only half, is it flogging?
But let them who find not [the means for] marriage abstain [from sexual relations] until Allah enriches them from His bounty. And those who seek a contract [for eventual emancipation] from among whom your right hands possess - then make a contract with them if you know there is within them goodness and give them from the wealth of Allah which He has given you. And do not compel your slave girls to prostitution, if they desire chastity, to seek [thereby] the temporary interests of worldly life. And if someone should compel them, then indeed, Allah is [to them], after their compulsion, Forgiving and Merciful. - Quran:An-Nur 24:33 (islam)

Chapter: The selling of an adulterer slave
Narrated Abu Huraira:
The Prophet (ﷺ) said, "If a slave-girl commits illegal sexual intercourse and it is proved beyond doubt, then her owner should lash her and should not blame her after the legal punishment. And then if she repeats the illegal sexual intercourse he should lash her again and should not blame her after the legal punishment, and if she commits it a third time, then he should sell her even for a hair rope." - Sahih:Al Bukhari:2152 (islam)
-How could you survive to 50 lashs when you are a slave girl?
Chapter: The sale id a slave who is promised to be manumitted
Narrated Abu Huraira:
I heard the Prophet (ﷺ) saying, "If a slave-girl of yours commits illegal sexual intercourse and her illegal sexual intercourse is proved, she should be lashed, and after that nobody should blame her, and if she commits illegal sexual intercourse the second time, she should be lashed and nobody should blame her after that, and if she does the offense for the third time and her illegal sexual intercourse is proved, she should be sold even for a hair rope." - Sahih:Al Bukhari:2234 (islam)
-To whom should such a slave be sold?
And [also prohibited to you are all] married women except those your right hands possess. [This is] the decree of Allah upon you. And lawful to you are [all others] beyond these, [provided] that you seek them [in marriage] with [gifts from] your property, desiring chastity, not unlawful sexual intercourse. So for whatever you enjoy [of marriage] from them, give them their due compensation as an obligation. And there is no blame upon you for what you mutually agree to beyond the obligation. Indeed, Allah is ever Knowing and Wise. - Quran:An-Nisa 4:24 (islam)

He can go back to her provided that she has not begun her third menstrual period since the pronouncement of divorce (assuming she has menstrual periods and is a free woman). If the wife is a slavegirl who has menstrual periods, he can go back to her provided she has not yet begun her second period. [He can take her back because the marital ties continue between them except for intercourse. Taking her back is with the intention and the statement, like "I take her back," "I keep her," or things which take the place of word like intercourse and foreplay, but there must be an intention with the intercourse. Intercourse without the intention is not taking back.] - Fiqh:Rissala:32.14d (islam)
It is halal to have sexual intercourse with women of the People of the Book if you own them as slaves or are married to any of their free women, but it is not halal for either a free man or a slave to have sexual intercourse with slavegirls from among the people of the Book through marriage to them. [This is based on the ayat of Allah, "or what your right hands own." We read in adh-Dhakira that because the People of the Book have been honoured by the Book and addressed by the Almighty Lord, their women and food are permitted. Others lack this honour by their deprival. It is reported from 'Abdullah ibn 'Umar ibn al-Khattab that it is not permitted to marry a free Kitabi woman by evidence of the ayat of al-Baqara. He says, "There is no shirk greater than her statement that her Lord is 'Isa."] - Fiqh:Rissala:32.6b (islam)
